CMS Clarifies How ABLE Accounts Impact Medicaid EligibilityNew guidance is good news for people with disabilities

While it’s generally understood that assets in ABLE accounts don’t count against eligibility for federal means-tested programs, the Centers for Medicare and Medicaid Services (CMS) this month laid out in clearer terms how the tax-advantaged savings accounts for individuals with disabilities should be calculated when determining Medicaid eligibility.

“State Medicaid agencies must disregard all funds in an ABLE account in determining the resource eligibility of Medicaid applicants and beneficiaries who are subject to a resource test,” writes Brian Neale, director of the Center for Medicaid & CHIP Services in guidance to state Medicaid officials.
